Acceptable Use Policy — TriveniCo

1. Overview

This Acceptable Use Policy ("AUP") defines the rules and guidelines for using TriveniCo's platform, services, and website (collectively, the "Services"). By using our Services, you agree to comply with this AUP, our Terms of Service, Privacy Policy, and all applicable laws.

We reserve the right to modify this AUP at any time. Material changes will be communicated via email or in-app notification. Your continued use of the Services after changes constitutes acceptance.

Core Principle: TriveniCo is a platform for legitimate commerce. We enable entrepreneurs to build sustainable businesses. Any use that undermines this mission, harms others, or violates the law is prohibited.

2. Prohibited Activities

You may not use the Services for any of the following activities:

2.1 Illegal Activities

  • Fraud, money laundering, sanctions evasion, tax evasion
  • Sale of counterfeit, pirated, or unauthorized goods
  • Violation of export controls, sanctions, or trade restrictions
  • Securities fraud, pyramid schemes, Ponzi schemes
  • Any activity illegal under applicable local, national, or international law

2.2 Financial Crimes

  • Payment processing for illegal activities
  • Structuring transactions to evade reporting requirements
  • Use of stolen payment credentials or fraudulent chargebacks
  • Money transmission without required licenses

2.3 Harm to Others

  • Harassment, bullying, threats, or intimidation
  • Doxxing, stalking, or non-consensual sharing of private information
  • Incitement to violence or self-harm
  • Human trafficking, exploitation, or forced labor

2.4 Platform Abuse

  • Automated scraping, crawling, or data extraction without permission
  • Credential stuffing, brute force attacks, or account takeover attempts
  • Denial of service attacks or attempts to degrade service performance
  • Reverse engineering, decompiling, or attempting to extract source code
  • Bypassing rate limits, authentication, or security controls
  • Creating multiple accounts to circumvent limits or manipulate metrics

3. Prohibited Content

You may not upload, display, distribute, or facilitate the distribution of:

Illegal & Harmful

  • Child sexual abuse material (CSAM) - zero tolerance, immediate reporting to NCMEC/law enforcement
  • Non-consensual intimate imagery (NCII) / revenge porn
  • Terrorist propaganda or extremist content
  • Instructions for violence, weapons manufacturing, or illegal acts
  • Content promoting self-harm, suicide, or eating disorders

Hate & Discrimination

  • Content attacking protected groups (race, religion, gender, sexuality, disability, etc.)
  • White supremacist, neo-Nazi, or extremist ideology
  • Holocaust denial or genocide revisionism
  • Dehumanizing language or slurs

Deceptive & Fraudulent

  • Fake reviews, testimonials, or social proof
  • Misleading product claims, bait-and-switch tactics
  • Impersonation of brands, individuals, or organizations
  • Phishing, spoofing, or social engineering content

Intellectual Property Violations

  • Copyright infringement (unauthorized copies, pirated content)
  • Trademark infringement (counterfeits, unauthorized use of brands)
  • Patent or trade secret violations
  • Right of publicity violations (unauthorized use of likeness)

4. Prohibited Products & Services

The following products and services may not be sold, promoted, or facilitated through TriveniCo:

5. Intellectual Property

5.1 Your Content

You retain ownership of content you upload. By uploading, you grant TriveniCo a worldwide, non-exclusive, royalty-free license to host, display, reproduce, modify, and distribute your content solely to operate the Services.

You represent that you own or have rights to all content you upload.

5.2 TriveniCo IP

All rights to the Services (excluding Your Content), including software, design, trademarks, logos, trade dress, and algorithms, are owned by TriveniCo. You receive a limited, non-exclusive, revocable license to use the Services per our Terms.

5.3 Feedback

Any feedback, suggestions, or ideas you provide become TriveniCo's property and may be used without compensation or attribution.

5.4 DMCA / Copyright

We comply with the Digital Millennium Copyright Act. To report infringement, contact dmca@trivenico.com with:

  • Identification of the copyrighted work
  • Identification of the infringing material and its location
  • Your contact information
  • Statement of good faith belief
  • Statement of accuracy under penalty of perjury
  • Your physical or electronic signature

6. Platform Abuse & Security

6.1 Automated Access

You may not access the Services through automated means (bots, scrapers, crawlers) without our prior written permission, except for:

  • Search engine crawlers respecting robots.txt
  • Approved API integrations via our Developer Platform
  • Accessibility tools for users with disabilities

6.2 Security Testing

Security research is welcome through our Bug Bounty Program at security.trivenico.com. Unauthorized testing is prohibited:

  • Penetration testing without authorization
  • Vulnerability scanning of production systems
  • Social engineering of TriveniCo staff or users
  • Disclosure of vulnerabilities without coordinated disclosure

6.3 Account Security

  • Use strong, unique passwords and enable MFA
  • Never share credentials or API keys
  • Report suspected compromise immediately to security@trivenico.com
  • Do not sell, transfer, or share accounts

7. Spam & Communications

7.1 Anti-Spam

You may not use the Services to send unsolicited bulk communications:

  • Commercial emails without consent (CAN-SPAM, CASL, GDPR compliant)
  • Unsolicited SMS/MMS (TCPA compliant)
  • Spam on social platforms, messaging apps, or forums
  • Automated messaging at scale without consent

7.2 Communication Standards

  • Honor opt-out/unsubscribe requests within 10 business days
  • Include accurate sender identification and contact information
  • No deceptive subject lines or sender spoofing
  • Provide clear opt-out mechanism in every commercial message

7.3 Platform Communications

You may not use TriveniCo's communication tools (email, SMS, chat, push) for spam, harassment, or prohibited content. We monitor for abuse and may suspend messaging privileges.

8. Data Privacy & Protection

8.1 Data Minimization

Collect only data necessary for your business. Do not collect sensitive data (health, biometrics, children's data) without explicit consent and legal basis.

8.2 Data Security

Implement appropriate technical and organizational measures: encryption, access controls, breach notification procedures, vendor management.

8.3 Data Subject Rights

Respect data subject rights: access, rectification, erasure, portability, restriction, objection. Respond to requests within legal timeframes (30 days GDPR, 45 days CCPA).

8.4 Cross-Border Transfers

Use appropriate safeguards for international transfers: SCCs, adequacy decisions, BCRs, or data localization where required.

9. Legal Compliance

You are responsible for complying with all applicable laws in jurisdictions where you operate, including but not limited to:

Consumer Protection

  • Truth in advertising, fair pricing, clear terms
  • Return/refund policies, warranty obligations
  • Cooling-off periods, distance selling regulations

Tax & Financial

  • Sales tax/VAT/GST collection and remittance
  • Income reporting, invoicing requirements
  • Anti-money laundering (AML) where applicable

Product-Specific

  • Product safety, labeling, certification
  • Age verification for restricted products
  • Recall procedures, hazard reporting

Data & Privacy

  • GDPR (EU), CCPA/CPRA (California), LGPD (Brazil)
  • PIPEDA (Canada), Privacy Act (Australia)
  • Sector-specific: HIPAA, FERPA, COPPA, PCI DSS

10. Enforcement & Consequences

Violations of this AUP may result in:

Progressive Enforcement

  1. Warning: Written notice with opportunity to cure (typically 7-30 days)
  2. Feature Restriction: Suspension of specific features (messaging, ads, listings)
  3. Account Suspension: Temporary loss of access (24 hours to 30 days)
  4. Account Termination: Permanent revocation of access
  5. Legal Action: Injunctions, damages, referral to law enforcement

Immediate Action

We may take immediate action without prior notice for:

  • CSAM, NCII, or child exploitation content
  • Active security threats or ongoing fraud
  • Court orders or legal requirements
  • Imminent harm to users or platform integrity

Appeals

You may appeal enforcement actions by emailing appeals@trivenico.com within 30 days. Provide your account details, the action taken, and why you believe it was in error. We review appeals within 14 business days.
