DMCA & Copyright Policy

1. Overview

TriveniCo respects the intellectual property rights of others and expects its merchants and users to do the same. TriveniCo responds to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512. This policy explains how to submit a takedown notice and a counter-notification.

2. Submitting a Takedown Notice

If you believe that content on the TriveniCo platform infringes a copyright you own or control, send a written notice to the designated agent below. To be effective under 17 U.S.C. Section 512(c)(3), the notice must include:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed, or a representative list of such works.
  • Identification of the material claimed to be infringing, including enough information to locate it, such as a URL.
  • Your contact information, including an address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

3. Counter-Notification Process

If your content was removed or disabled due to a takedown notice and you believe the removal was a mistake or misidentification, you may submit a counter-notification. To be effective, the counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material removed or disabled and its prior location.
  • A statement, made under penalty of perjury, that you have a good faith belief the material was removed by mistake or misidentification.
  • Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal district court for your address, or, if outside the United States, any judicial district in which TriveniCo may be found, and that you will accept service of process from the complaining party.

TriveniCo may restore the removed content after receiving a valid counter-notification, subject to applicable law.

4. Repeat Infringer Policy

TriveniCo maintains a policy of terminating, in appropriate circumstances, the accounts of users and merchants who are repeat infringers. TriveniCo may also remove or disable access to content that is the subject of a valid takedown notice.
