Terms of Service

These Terms of Service govern your access to and use of TriveniCo's platform, including the marketplace, point-of-sale (POS), AI voice receptionist, CRM, analytics, and payments tools (together, the "Services"). By creating an account or using the Services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms and the Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and Accounts

You must be at least 18 years old and capable of forming a binding contract to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to update it as needed.

3. Merchant and Marketplace Rules

Merchants using the Services agree to:

  • List only lawful products and services that you have the right to sell.
  • Provide accurate product descriptions, pricing, and availability.
  • Fulfill orders, honor refunds, and respond to buyers in a timely manner.
  • Comply with applicable laws, including consumer protection and tax obligations.
  • Follow the TriveniCo Acceptable Use Policy.

4. Zero Transaction Fees

TriveniCo does not charge merchants a per-transaction fee for sales processed through the platform. This zero transaction fee commitment applies to platform transaction fees. Payment processing, currency conversion, or third-party service fees may still apply and are disclosed separately.

5. Prohibited Conduct

You agree not to misuse the Services, including by:

  • Violating any applicable law or regulation.
  • Infringing the intellectual property or privacy rights of others.
  • Uploading malicious code or attempting to compromise the security of the platform.
  • Engaging in deceptive, fraudulent, or misleading practices.
  • Interfering with or disrupting the integrity or performance of the Services.

6. Intellectual Property

The Services, including software, branding, and content, are owned by TriveniCo and are protected by intellectual property laws. TriveniCo grants you a limited, non-exclusive, non-transferable license to use the Services. You retain ownership of the content you submit, and you grant TriveniCo a license to host and display that content to operate the Services.

7. Third-Party Services

The Services may integrate with third-party products and services. TriveniCo is not responsible for the practices, content, or availability of third-party services, and your use of them is subject to their own terms.

8. Termination

You may stop using the Services at any time. TriveniCo may suspend or terminate your access if you violate these Terms, if required by law, or to protect the safety and integrity of the platform. Upon termination, your right to use the Services ends, though provisions that by their nature should survive will remain in effect.

9. Disclaimers and Limitation of Liability

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, TriveniCo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to your use of the Services. TriveniCo's total liability will not exceed the greater of one hundred U.S. dollars or the amounts you paid to TriveniCo in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless TriveniCo and its affiliates, officers, and employees from any claims, damages, losses, or expenses arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

11. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which TriveniCo is established, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of that jurisdiction. You agree to attempt to resolve disputes informally by contacting TriveniCo before pursuing formal action.

12. Changes to These Terms

TriveniCo may update these Terms from time to time. Material changes will be communicated through the Services or by other reasonable means. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
